Terms and
Conditions
Customers who use Technical
Support by telephone or by e-mail may not use the service in an
excessive manner, and each contact incident may be limited to a
length of 15 minutes. Property Sidekick, Inc. reserves the right to
terminate the Technical Support, whether free or paid, of any
customer who is abusive to the Property Sidekick representatives or
fraudulent in their use of the service. Technical Support by e-mail
is offered as a free service to Property Sidekick customers and
Technical Support by phone may be purchased by the customer if
desired.
Terms, conditions, policies, procedures, pricing and support
availability are subject to change at any time without notice.
Service hours are subject to change due to holidays, downtime due to
server maintenance, repair or other unforeseen emergencies.
Non-Transferable
Support Packages are non-transferable and are valid only for the
individual purchaser at a single location. Support is available only
to end-users.
Support Topic Limitations
Technical Support provided by Property Sidekick covers the
discussion of installation and setup of your software, questions
about the use and function of the software, and error messages
received within the Park Sidekick software. We cannot help you with
network or printer issues that are unrelated to Park Sidekick or
error messages you may receive that are unrelated to the Park
Sidekick software. Technical Support does not cover advice or
inquiries about accounting or property management business
practices. Extensive training is not covered by free or purchased
Technical Support. If you need training, (meaning you need someone
to walk you through setting up your properties, tenants or
collecting rents and explaining the software to you in depth), then
you must purchase a Training Package.
Program Bugs
When it is determined that the problem that a user is experiencing
is due to a bug in the software, the charge for any paid Technical
Support will be refunded. It is the user's responsibility to
download the latest update before requesting technical support. If
the bug reported has been fixed and is available in a free
downloadable update from our website, then any paid Technical
Support will still be charged to the user. Bugs are defined as
problems in the software that cause a mathematical error, or cause
the software to not perform as described in the manual. Bugs are not
feature requests, or expectations by the user that the software
perform in a particular way. Final determination about whether a
particular problem is due to a bug will be made by Property
Sidekick, Inc.
Products
Technical Support is available for Park Sidekick.
No Liability for Damages
In no event shall Property Sidekick, Inc. be liable for any damages
whatsoever (including without limitation, damages for loss of
business profits, business interruption, loss of business
information, or any other pecuniary loss) arising out of the use of
customer Technical Support, even if Property Sidekick, Inc. has been
advised of the possibility of such damages.
Property Sidekick, Inc.'s sole liability, and the customer's sole
remedy, for any loss suffered by the customer arising under the use
of Technical Support, whether free or paid, will be a 10% refund of
the total fees paid by the customer to Property Sidekick, Inc. for
the 12-month period during which the loss is suffered. Under no
circumstances will Property Sidekick, Inc. be liable to the customer
for consequential damages.

PROPERTY SIDEKICK, INC. SUPPORT SERVICES ARE PROVIDED "AS IS."
PROPERTY SIDEKICK, INC. HEREBY DISCLAIMS ALL REPRESENTATIONS AND
WARRANTIES, EXPRESS AND IMPLIED, REGARDING THE SERVICES OR ANY
RELATED MATERIALS, INCLUDING FITNESS FOR A PARTICULAR PURPOSE,
QUALITY, MERCHANTABILITY, ACCURACY AND NON-INFRINGEMENT. IN NO EVENT
SHALL PROPERTY SIDEKICK, INC. BE LIABLE FOR ANY SPECIAL, INCIDENTAL,
INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES
WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS
OF USE, DATA OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY
OF SUCH DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN
CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICES AND
INFORMATION PROVIDED.
Refunds
All sales are final on the fees paid for Technical Support.
